Terms of Care & Service Agreement

Welcome to Own Your Birth Coaching. By booking our services, accessing our website, or participating in our coaching programs, you agree to comply with and be bound by the following Terms of Care. Please read them carefully.

1. Scope and Nature of Services

  • Educational and Advocacy Support: Own Your Birth Coaching provides non-clinical birth trauma coaching, physiological birth education, and practical advocacy preparation. Our core focus is to help you sift through the medical system, understand normal physiology, and articulate your preferences.

  • Not Medical Advice or Psychotherapy: Services provided by Own Your Birth Coaching do not constitute medical advice, diagnosis, clinical midwifery care, obstetric services, or licensed psychological therapy/mental health treatment. We do not perform clinical assessments, internal exams, or medical interventions.

  • Independent Decision-Making: All decisions regarding your pregnancy, labor, birth, and postpartum care remain entirely yours. You retain full responsibility for your medical choices, actions, and outcomes.

2. Client Responsibilities & Honest Disclosure

  • Truthful Information: You agree to provide accurate and truthful information regarding your medical history, past birth experiences, and current health status during intake forms and coaching sessions.

  • Active Participation: Our framework relies on your active engagement. You agree to communicate openly, respect scheduled session times, and take an active role in practicing your advocacy tools.

  • Emergency Protocols: In the event of a medical emergency during pregnancy or postpartum, you agree to immediately contact your primary healthcare provider, obstetrician, midwife, or emergency services (e.g., 000 in Australia). Coaching sessions are never a substitute for emergency medical care.

3. Booking, Payments, and Cancellations

  • Fees and Invoicing: All coaching sessions and programs must be paid for in advance through our approved payment gateway (e.g., Stripe, PayPal). Prices are listed in AUD (or specified currency) and are non-refundable except as outlined below.

  • Rescheduling and Cancellations: If you need to reschedule a 1:1 session, you must provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice or missed appointments may forfeit the session fee at our discretion.

  • Package Expiry: Coaching packages and multi-session bundles must be utilized within the timeframe specified at purchase (typically 6 months) unless otherwise agreed in writing.

4. Intellectual Property Rights

  • All materials, guides, frameworks, workbooks, branding, and content provided by Own Your Birth Coaching are the exclusive intellectual property of the business.

  • You are granted a limited, non-exclusive, non-transferable license to use these materials for your personal, private pregnancy and birth preparation. You may not reproduce, distribute, resell, or share our proprietary content publicly or commercially without explicit written consent.

5. Confidentiality and Privacy

  • We respect the deeply personal nature of your birth story and data. All personal and health-related information shared during coaching sessions is handled in strict accordance with our Privacy Policy.

  • While we maintain professional confidentiality, please note that electronic communications carry inherent risks. We utilize secure platforms to protect your data.

6. Limitation of Liability & Disclaimer of Outcomes

  • No Outcome Guarantees: Birth is inherently unpredictable. Own Your Birth Coaching makes no guarantees, warranties, or promises regarding specific birth outcomes, medical compliance by hospital staff, or emotional resolutions.

  • Release of Liability: To the maximum extent permitted by Australian law, Own Your Birth Coaching, its founder, and representatives shall not be held liable for any direct, indirect, incidental, or consequential damages, medical complications, or adverse outcomes arising from your pregnancy, birth, or medical choices. You release us from any claims related to your interactions with the medical system.

7. Governing Law

These Terms of Care are governed by and construed in accordance with the laws of Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Australia.

8. Changes to Terms

We reserve the right to modify these Terms of Care at any time. Updated versions will be posted on our website with a revised effective date. Continued use of our services constitutes your agreement to the modified terms.
